Terms and Conditions

These Terms and Conditions govern enquiries, reservations, purchases, and participation in tours offered by Still Waters Scenic Tours.

By requesting, booking, paying for, or participating in a tour, the booking customer confirms that they have read and accepted these terms on behalf of themselves and the other guests included in the booking.

 

1. Our Tours

Still Waters provides private scenic driving tours from Calgary to selected destinations in Alberta, including mountain, lake, Badlands, museum, viewpoint, dining, picnic, and custom-tour experiences.

Tour descriptions, stops, driving times, and durations are estimates. They may change because of weather, traffic, road conditions, park restrictions, closures, crowd levels, safety concerns, guest needs, or circumstances beyond our reasonable control.

Specific wildlife sightings, weather, visibility, water colour, foliage, parking availability, or access to any particular attraction cannot be guaranteed.

2. Booking Requests

Submitting a request does not create a confirmed reservation.

A booking becomes confirmed only when Still Waters accepts the requested date and itinerary, the customer receives written confirmation, and any required deposit or payment has been received.

We may accept or decline a booking request based on availability, safety, route feasibility, vehicle capacity, operating requirements, or incomplete information.

3. Booking Customer's Responsibility

The person making the booking must be at least 18 years old, have authority to book for all guests, provide accurate information, communicate these terms to all guests, ensure guests arrive on time, disclose relevant needs, and notify us promptly of changes.

The booking customer is responsible for amounts owing for the entire group.

4. Prices and Taxes

Prices are displayed in Canadian dollars unless stated otherwise.

The quoted price will specify whether it applies per private group, per vehicle, per guest, from a stated starting price, or by custom quotation.

Applicable taxes and optional extras may be added where required.

Prices may change before confirmation. Once a booking has been confirmed, the agreed price will not change unless the customer requests a change in itinerary, duration, pickup arrangement, group size, or inclusions.

5. Deposits and Payment

A deposit may be required to secure a booking. The balance and payment deadline will be stated in the confirmation.

A booking is not secured until the required payment has been received.

Where payment is processed through a third party, the customer must also comply with that provider's terms.

6. What Is Included

Only items expressly listed in the booking confirmation are included.

Unless specifically stated, the tour price does not include attraction or museum admission, meals or beverages, parking charged directly to guests, souvenirs, optional activities, gratuities, personal purchases, or travel or medical insurance.

7. Cancellation Policy

More than 7 days before departure: refund of payments received, less any stated non-refundable booking or processing fee.

3-7 days before departure: 50% refund.

Less than 72 hours before departure: non-refundable.

No-show or missed departure: non-refundable.

For custom tours, prepaid attractions, catering, reserved meals, or other special arrangements, non-refundable third-party costs may be deducted from any refund.

Approved refunds will be returned to the original payment method where reasonably possible.

8. Changes or Cancellation by Still Waters

We may change, postpone, shorten, reroute, or cancel a tour because of dangerous weather, wildfire, smoke, flooding, avalanche, road closures, government restrictions, vehicle breakdown, driver illness, safety concerns, attraction closure, or events beyond our reasonable control.

Where Still Waters cancels the entire tour and cannot offer a reasonable alternative date, the customer will receive a refund of amounts paid directly to Still

Waters for the cancelled service.

We are not responsible for additional losses such as hotel costs, flights, missed reservations, lost wages, or other indirect expenses. Guests are encouraged to purchase appropriate travel insurance.

9. Pickup and Punctuality

Guests must be ready at the confirmed pickup location at the agreed time.

A short grace period may be provided where practical. Significant delay may result in reduced time at stops, removal of a stop, additional charges, or cancellation as a no-show where the tour can no longer be completed safely or reasonably.

Guests must provide accurate pickup information and a reachable telephone number.

 

10. Vehicle Capacity and Seating

The maximum number of guests depends on the vehicle, available seatbelts, luggage, required child seats, and safe seating arrangements.

Every guest must use an available seatbelt whenever the vehicle is moving.

Guests may not exceed the confirmed group size without prior approval.

11. Children and Child Seats

Children must be accompanied and supervised by a parent or responsible adult.

The booking customer must disclose children's ages and child-seat or booster-seat needs before confirmation.

Still Waters may decline transport where a safe and legally appropriate seating arrangement cannot be provided.

Parents and guardians remain responsible for supervising children at all stops.

 

12. Accessibility and Health Considerations

Guests should disclose mobility or accessibility needs that may affect transportation, walking, entry, or emergency planning.

We will make reasonable efforts to adapt the experience, but not every location, trail, viewpoint, washroom, or attraction is fully accessible.

Guests are responsible for deciding whether they are physically able to participate. Tours may involve uneven surfaces, steps, snow or ice, gravel, short walks, higher elevations, changing weather, and limited washroom access.

Guests should bring required medication and personal mobility aids.

13. Food, Allergies, and Dietary Needs

Guests must inform us of relevant food allergies or dietary requirements before the tour.

We will make reasonable efforts to communicate needs to restaurants or food providers, but we cannot guarantee an allergen-free environment or prevent cross-contact in third-party kitchens.

Meals purchased from restaurants or other providers are subject to the provider's own ingredients, handling, pricing, and policies.

14. Guest Conduct

Guests must act respectfully and follow reasonable safety instructions.

Still Waters may refuse service or end a guest's participation, without refund, where conduct is unsafe, unlawful, abusive, threatening, discriminatory, severely disruptive, or damaging to the vehicle, environment, property, guide, or other people.

Open alcohol, illegal drugs, smoking, and vaping are not permitted in the vehicle.

 

15. Alcohol and Impairment

Guests who appear significantly impaired may be refused transportation or participation where safety could be affected.

Guests remain responsible for complying with applicable alcohol laws and the rules of restaurants, attractions, parks, and public spaces.

 

16. Wildlife and Natural Areas

Wildlife is unpredictable. Guests must remain at a safe distance, follow guide and park instructions, never feed or pursue wildlife, avoid leaving food or waste, and remain on permitted pathways where required.

Still Waters may immediately relocate or end a stop where wildlife or environmental conditions create a risk.

 

17. Personal Property

Guests are responsible for phones, cameras, luggage, clothing, souvenirs, documents, and other personal property.

Still Waters is not responsible for loss, theft, or damage except to the extent caused by our proven failure to exercise reasonable care.

Any property found in the vehicle will be held for a reasonable period. Delivery or shipping costs are the guest's responsibility.

 

18. Photography

Guests may take personal photographs where permitted.

Commercial photography, drones, professional productions, or photography requiring permits must be disclosed in advance.

Photographs must comply with park, attraction, property, aviation, and privacy rules.

 

19. Assumption of Ordinary Travel Risks

Travel in mountain and rural areas involves ordinary risks, including weather changes, traffic, road conditions, wildlife, uneven terrain, slips, falls, elevation, insects, and delayed emergency response.

Guests agree to follow safety instructions and accept the ordinary risks reasonably associated with the selected activities.

Nothing in these terms excludes liability that cannot legally be excluded.

 

20. Third-Party Providers

Museums, restaurants, attractions, parks, ferries, and activity providers are independent organizations.

Still Waters is not responsible for their operations, prices, hours, closures, service quality, safety rules, refund policies, lost property, or acts or omissions.

We may assist with coordination, but any direct purchase from a third party forms a separate relationship between the guest and that provider.

 

21. Website Information

We aim to keep website information accurate, but photographs, itineraries, travel times, operating hours, prices, and availability may change.

Website photographs are illustrative. Actual weather, scenery, seasonal appearance, crowds, vehicle, and conditions may differ.

 

22. Intellectual Property

The Still Waters name, logo, website copy, original photographs, tour descriptions, graphics, and branding may not be reproduced or used commercially without written permission.

Guests retain ownership of their own photographs, subject to applicable location and third-party rules.

 

23. Privacy

Personal information is handled according to the Still Waters Privacy Policy and applicable privacy law.

 

24. Governing Law

These terms are governed by the laws of Alberta and the applicable federal laws of Canada.

Any dispute will be brought before a court or tribunal with lawful jurisdiction in Alberta, unless applicable consumer law requires otherwise.

 

25. Severability

If any term is found unlawful or unenforceable, the remaining terms will continue to apply.

 

26. Changes to These Terms

We may update these terms from time to time. The terms in effect when a booking is confirmed will generally govern that booking unless a change is required by law or agreed to in writing.
